The Supreme Court of India has approved for re-investigation of the tax documents of 2011-12 for Sonia Gandhi, Rahul Gandhi and Oscar Fernandes to the Income Tax Department in the National Herald case. However, the Court has not yet given any final order in this matter. The Court has fixed the date of January 8, 2019 for further hearing on this matter. The High Court had refused to ban the re-examination of the two income tax documents in September, after which Sonia and Rahul Gandhi challenged the Delhi High Court’s decision in the Supreme Court.
In the hearing on November 13, the court had a big setback to Rahul and Sonia Gandhi. The court refused to ban the notice issued to him by the Income Tax Department. However, the court had agreed to hear Sonia and Rahul’s plea. On September 10, the Delhi High Court dismissed the petitions saying that the Income Tax Department has the right to double check the tax process.
If the petitioners have any complaint then they can go to the department for this. The High Court’s decision was challenged by the two leaders in the Supreme Court and demanded a ban on the order of the Income Tax Department to re-investigate the ‘tax assessment’ associated with the National Herald and Young India. The issue of income tax investigation against Congress leaders was raised by BJP leader Subramanian Swamy. The matter was raised by Swami investigating the private criminal complaint filed in the lower court in connection with the National Herald case. Along with Rahul Gandhi and Sonia Gandhi, Oscar Fernandes is also on bail in this case. Sonia and Rahul were granted bail on December 19, 2015 by the trial court.
